SMS Consent & Opt-In Flow

GX Web Studio (operated by Build and Grow Capital LLC) provides SMS automation services to local businesses and operates an SMS notification stream for the business owners who use the GX Web Studio platform. This page documents how end users (both the customers of our business clients and the business owners who use our platform) provide express consent before receiving any SMS messages, how their data is handled, and the terms of the SMS program.
Who Sends the Messages
Messages are sent on behalf of our business clients (for example, a local home service contractor). Each message clearly identifies the sending business by name. GX Web Studio operates the underlying messaging infrastructure and is identified as the service provider on request.
How End Users Opt In
End users provide express consent through one of three documented methods. Each method captures and timestamps the consent before any SMS message is sent.
Method 1: Signed service agreement
- The business presents a written service agreement to the customer before work begins.
- The service agreement contains a dedicated SMS Communications Consent clause (see exact language below).
- The customer signs the service agreement, which constitutes express written consent to receive SMS messages.
- The signed agreement is retained by the business and produced on request for carrier or regulatory audit.

“By providing your phone number, you consent to receive SMS messages from [Business Name] and its service providers, including appointment confirmations, reminders, service updates, and a post-service review request. Message frequency varies (typically 1-4 messages per service interaction). Msg & data rates may apply. Reply STOP to opt out, HELP for help. Consent is not required for purchase.”

Method 2: Online form or appointment scheduler
- The customer visits the business's website and completes a contact, quote, or appointment scheduling form that requests a phone number.
- The form includes a clearly labeled, unchecked SMS consent checkbox immediately adjacent to the phone number field. The checkbox is never pre-checked.
- The customer must actively check the box to opt in. The associated phone number is only added to the SMS platform if the box is checked at submit time.
- On submission, the platform records the consent text shown to the customer, the IP address, the user agent, and a server-side timestamp.
- The consent record is retained and produced on request for carrier or regulatory audit.

Method 3: Business owner platform onboarding
- A business owner signs up for the GX Web Studio platform via the signup form at https://gxwebstudio.com/get-started.
- The signup form includes a clearly visible, unchecked SMS consent checkbox immediately adjacent to the phone number field. The checkbox is never pre-checked.
- The owner must affirmatively check the box to opt in. The phone number is only added to the platform's operational SMS list if the box is checked at submit time.
- On submission, the platform records the consent text shown to the owner, the IP address, the user agent, and a server-side timestamp.
- The consent record is retained and produced on request for carrier or regulatory audit.
- Operational SMS messages from the platform to the owner include workflow triggers, lead notifications, schedule queries, content approvals, and account updates.

Common platform safeguards (all methods)
- Mandatory confirmation checkbox. Before any customer phone number is added to the GX Web Studio platform, the business must check a mandatory confirmation indicating which of the three methods above was used to obtain consent. Phone numbers cannot be added without this confirmation.
- Onboarding attestation. During onboarding, each business client signs a platform attestation confirming that they will only submit phone numbers of customers who provided consent via one of the documented methods.
- Platform-wide opt-out propagation. When a customer opts out by replying STOP, the opt-out is processed immediately and propagated across the entire GX Web Studio platform. The number will not receive messages from any business using our platform, regardless of which client originally added it.
What Messages End Users Receive
For customers (Methods 1 and 2):
- Form submission confirmations (immediate response when a customer submits a contact or inquiry form)
- Appointment booking confirmations (sent immediately after an appointment is scheduled online or by phone)
- Appointment reminders (sent the night before or morning of a scheduled appointment)
- Service updates related to the customer's project
- A post-service review request asking the customer to leave a Google review
- Up to one or two follow-up review reminders if no response
For business owners (Method 3):
- New customer lead notifications (form submissions, calls, quote requests)
- Quote approval requests with summary details
- Review notifications when a customer leaves feedback
- Schedule queries (e.g., text ‘schedule’ to receive today's appointments)
- Content approval prompts for social media or blog posts
- Account and billing updates
Note: Customer-facing message frequency typically ranges from 1 to 4 messages per service interaction. Owner-facing operational messages typically range from 1 to 10 per business day depending on platform activity. We do not send promotional or marketing messages through this program.
How to Opt Out
Customers can opt out at any time by replying STOP to any message. Opt-outs are processed immediately and propagated across the entire GX Web Studio platform. Once a number opts out, it will not receive messages from any business using our platform. Customers can reply HELP at any time to receive support contact information.
Privacy & Data Handling
Information we collect. GX Web Studio (operated by Build and Grow Capital LLC) collects and processes mobile phone numbers, SMS opt-in records (method, timestamp, source), message delivery logs, and opt-out events for the purpose of operating SMS messaging services on behalf of our business clients.
No sharing for marketing. Mobile phone numbers and SMS opt-in data are not shared with third parties or affiliates for marketing or promotional purposes. The categories of information shared with third parties exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Limited disclosures. Data is shared only with:
- Twilio, our messaging infrastructure provider, for the purpose of message delivery.
- The specific business client whose customer the recipient is.
- Law enforcement or regulators where required by law.
Data deletion. Customers may request deletion of their data at any time by contacting GX Web Studio at beau@gxwebstudio.com.
